Federal Government Sues Over Limits on ICE and Other Agents

Philadelphia is trying to criminalize the work of federal agents in the city where the Constitution was born — and the Department of Justice (DOJ) is fighting back in court.

DOJ Takes Philadelphia to Court

The Department of Justice filed a 28-page lawsuit against the City of Philadelphia on Thursday, June 18, 2026. The suit names Mayor Cherelle Parker, District Attorney Lawrence Krasner, and City Solicitor Renee Garcia. The DOJ says Philadelphia’s new law illegally tries to control how federal agents do their jobs. The law bans masks, requires officers to wear individual ID, and blocks the use of unmarked vehicles during operations.[4]

The DOJ argues the U.S. Constitution’s Supremacy Clause settles this fight. That clause says federal law is the law of the land — and states or cities cannot boss around the federal government. Assistant Attorney General Brett Shumate put it plainly: “Philadelphia may not regulate federal operations and its unconstitutional attempt to do so must be stopped.” He also called it “disappointing to see the city where our Constitution was born so egregiously violate its separation of powers.”[4]

Officer Safety at the Heart of the Case

The DOJ says the Philadelphia law would force federal agents to choose between their safety and their jobs. If agents follow the law and unmask, they risk having their personal information exposed online — a practice known as doxing — as well as harassment and physical attack. The lawsuit says federal officers have already faced an “unprecedented wave” of harassment and violence. Threatening them with criminal charges for protecting their identities makes the problem worse.[4]

Even Philadelphia’s own City Solicitor raised red flags before the law was signed. The Solicitor warned that the bill had “significant legal problems” around the city’s authority to regulate federal officers on duty. The Solicitor also said the law “would send an inaccurate signal to the public” that the city could actually enforce it. Despite those warnings, city leaders pushed it through anyway.[4]

Part of a Nationwide Legal Campaign

The Philadelphia lawsuit is not a one-off. The DOJ has now sued multiple states and cities over similar laws. California was first — a federal judge there struck down a comparable mask ban in February 2026.[2] The DOJ has also sued New Jersey, Virginia, and Connecticut over laws that restrict how federal agents dress and identify themselves on the job.[4] New Jersey’s law, passed in February 2026, bans masks and requires officers to show ID before making arrests.[7]

New Jersey Attorney General Jennifer Davenport pushed back, saying her state’s law protects the public by limiting mask use to situations where safety truly requires it. She challenged the federal government to explain exactly when and why its agents need to hide their faces.[3] That argument has some surface appeal, but the courts have not been sympathetic. A federal judge already sided with the DOJ in the California case, and the constitutional argument — that states simply cannot dictate terms to the federal government — is well-established law. The DOJ shows no sign of backing down, and more lawsuits could follow.[2]
