
(PatriotSpotlight.org) – Andrew Bailey, Missouri’s Attorney General is attempting to sue the State of New York, following a Manhattan court’s handing down of a guilty verdict to ex-President Donald Trump on hush money charges, which Bailey objects to.
Bailey hopes his case will go all the way to the Supreme Court and is demanding that New York authorities be forced to declare it illegally interfered with the upcoming presidential election. Bailey also asks that the court delay the former President’s sentencing until after November’s hotly anticipated election. He also calls for Trump to be freed from any gag orders, which he said risks breaching constitutional rights in his own state.
Trump could face a hefty cumulative sentence of more than 140 years behind bars after being found guilty of 34 charges linked to falsifying business records to cover up an extramarital affair.
Bailey slammed the situation as being orchestrated by “Soros-backed” prosecutors, and said that it amounted to “poisonous” “lawfare” which hurt the country’s democracy. The lawsuit arrives as Trump’s sentencing has already been postponed until September 18 following a motion by Trump’s attorneys, Manhattan District Attorney Alvin Bragg failed to oppose. The motion claimed a fresh Supreme Court decision on the immunity of U.S. presidents put the New York conviction into question. This delay means Trump’s sentencing will occur after July’s RNC, where he is set to take up the party’s presidential nomination.
Writing to prosecutors and Trump’s lawyers, NY Supreme Court Justice Juan Merchan refused to specify any potential delay to sentencing but set out timelines for both parties to submit briefings on the immunity argument. Prosecutors have consented to the delay, even as they maintain the argument lacks merit. New York’s response to the lawsuit has not yet been disclosed.
Reports indicate that the delay is the first practical fallout from the Supreme Court’s ruling that ex-presidents also possess “absolute” immunity from criminal convictions over actions that could be perceived to be part of their “core constitutional powers.” The delay is seen as a tactical victory for Trump, allowing him to avoid sentencing in the immediate run-up to the election.
